Privacy Policy
Short version: we collect what you type into the form, plus basic context about how you found the Page. We use it to answer you. We do not sell it. The self-check never leaves your browser.
Who we are
Peak Employment Solutions (“Peak,” “we,” “us”) is a staffing and behavioral talent acquisition firm based in Augusta, Georgia, serving employers across the USA. This Privacy Policy explains what information we collect when you visit 46willfail.com (the “Page”), what we do with it, who else touches it, and the choices you have. It covers this Page only. Our other sites have their own policies, described in the section on other Peak sites below.
What we collect
Information you give us
If you fill out the “Tell us who you’re hiring” form, you give us your name, company, work email address, and the number of people you expect to hire in the next 90 days. You may also give us a phone number (optional) and a description of the roles that are hardest for you to keep filled (optional). We collect only what you type into those fields. Please do not include sensitive personal information, such as government ID numbers, financial account numbers, or health information, in the free-text box.
Information collected automatically
When you submit the form, the Page also records some context about your visit so we can understand which marketing brought you here and respond properly. That context is: the marketing source tag in the link you used (for example, whether you arrived from a postcard QR code, a Facebook post, or an email), any campaign tags attached to that link, whether the link came from a Facebook ad click, the website that sent you (if any), the address of the Page you landed on, your browser and device type, and your screen size. We do not record your IP address in our lead records.
Separately, if analytics is running, Google Firebase Analytics collects standard usage information when you visit, such as pages viewed, buttons clicked, approximate location (city or region level), device and browser details, and identifiers used to distinguish one visitor from another. See the analytics section below.
Information we do not collect
We do not ask for, and the Page does not collect, Social Security numbers, financial information, or job applications. We do not use advertising pixels or advertising trackers on this Page as of the effective date above. We do not sell your information.
How we use it
We use the information you submit to respond to you about Peak’s staffing and workforce solutions, including how we screen candidates before Day 1; to follow up with you by email or phone about the hiring needs you described; to keep a record of the inquiry and the relationship that follows; and to understand which of our marketing efforts are working so we can improve them. We use analytics information to understand how the Page is performing and to fix problems. We may use your email address to send you information related to your inquiry. If you ask us to stop contacting you, we will.
We do not use your information to make automated decisions that produce legal or similarly significant effects about you.
Who we share it with
We share information only as described here.
Our service providers
We use a small number of companies to run this Page, and they process information on our behalf. Google (Firebase and Google Cloud) hosts the Page, stores the information you submit in a database located in the United States, and provides analytics. Resend delivers the internal email that alerts our team when a new inquiry arrives; that email contains the information you submitted. These providers may only use the information to provide their services to us, under their own terms and privacy commitments.
Within Peak
Your inquiry is visible to the Peak team members who handle new business and may be recorded in Peak’s internal systems used to manage client relationships.
Legal and business reasons
We may disclose information if we believe in good faith that the law requires it, to respond to a lawful request, to protect the rights, safety, or property of Peak, our clients, or others, or to investigate fraud or abuse. If Peak is involved in a merger, acquisition, financing, or sale of all or part of its business, information may be transferred as part of that transaction, subject to this policy.
What we do not do
We do not sell your personal information. We do not share it with third parties for their own marketing, and we do not “share” it for cross-context behavioral advertising.
Analytics and cookies
The Page uses Google Firebase Analytics to count visits and understand which parts of the Page people use, such as which buttons are clicked and whether the form is started or completed. Analytics tools like this may use cookies, local storage, or similar technologies and device identifiers to recognize a browser across visits. Google’s handling of that data is described in Google’s own privacy policy at policies.google.com/privacy.
The Page’s fonts and images are hosted with the Page itself. The Page does not load advertising or social media tracking code. You can limit analytics by using your browser’s privacy settings, by blocking cookies and similar storage, or by using a browser extension that blocks analytics. Some browsers send a “Global Privacy Control” or “Do Not Track” signal. Because we do not sell or share your information for advertising, we treat such a signal as a request not to do so, which is already our practice.
If you arrive from a Facebook ad or post, Facebook may collect information about your interaction with that ad or post under Facebook’s own terms and privacy policy. That collection happens on Facebook, not on this Page.
The self-check
The Page includes an optional “two-minute self-check” for job seekers about the six qualities described on the Page: Ownership, Initiative, Follow-Through, Interest, Presence, and Fear. The check runs entirely in your own browser. Your answers and your results are not sent to us, are not stored by us, and are not connected to any form or record. When you leave or reload the Page, they are gone. We may count that a visitor finished the self-check (without any of the answers) as part of analytics. The self-check is a reflection tool. It is not a test, an assessment, or a hiring score, and it plays no part in any employment decision.
How long we keep it
We keep inquiry information for as long as reasonably needed to respond to you, to manage the business relationship that may follow, and to meet our legal, accounting, and record-keeping needs. If you ask us to delete your information, we will do so unless we are required or permitted by law to keep it, and we will tell you if that is the case. Analytics data is kept according to the retention settings we configure with Google.
Your choices and rights
You can ask us at any time to tell you what information we hold about you, to correct it, to delete it, or to stop contacting you. Email team@peaktcs.com from the address you used and tell us what you would like. We may need to confirm it is really you before we act, and we will respond within a reasonable time and in any event within the time the law requires.
You may unsubscribe from any marketing email using the link or instructions in that message, or by replying to ask us to stop.
State privacy rights
Depending on where you live, state privacy laws (including those in California, Colorado, Connecticut, Virginia, Texas, and other states) may give you rights to know what personal information a business collects and how it is used, to access and correct it, to delete it, to receive a copy of it, and to opt out of its sale, of targeted advertising, and of certain profiling. We do not sell personal information or use it for targeted advertising, and we do not knowingly sell or share the information of anyone under 16. You will not be treated differently for exercising any of these rights. To make a request, email us at the address above. If we deny a request, you may ask how to appeal, and we will explain the process.
Visitors outside the United States
This Page is directed to employers and job seekers in the United States. If you visit from elsewhere, you understand that your information will be processed in the United States, where privacy laws may differ from those in your country.
How we protect it
We use reasonable administrative, technical, and physical safeguards to protect the information you give us. Submissions travel over an encrypted connection (HTTPS), are stored with Google Cloud, and are accessible only to authorized Peak team members. The database is configured so that visitors to the Page can add an inquiry but cannot read, change, or delete any inquiry, including their own. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If you believe your information has been compromised, tell us right away at the address below.
Children
This Page is intended for adults. It is not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, contact us and we will delete it.
Other Peak sites and links
The Page links to other Peak sites, including peaktcs.com and peakaugusta.com, and to its pre-application at peakaugusta.com/pre-application. Those sites collect information under their own privacy practices, and the pre-application in particular collects more information than this Page does. Please read the privacy notice on those sites before you submit anything there. This Page may also link to third-party sites we do not control, and we are not responsible for their content or privacy practices.
Changes to this policy
We may update this policy from time to time. When we do, we will change the effective date at the top of this page. If a change is significant, we will make a reasonable effort to make it prominent. Continuing to use the Page after a change means you accept the updated policy.
